1. Eligibility and Accounts

Eligibility

At SB Tuition Centre, we aim to provide quality education and training to a wide range of learners. However, to maintain a high standard of service and ensure the safety and satisfaction of all our users, we have set certain eligibility criteria:

1.1. For Students:

  • Age Requirement: Students of all ages are welcome. However, for specialized coaching (e.g., JEE, NEET), the student must be enrolled in the relevant academic class.
  • Parental Consent: For students under the age of 18, registration on our platform or in-person at the Centre requires consent from a parent or legal guardian. This ensures that all decisions made regarding the student’s education are approved by a responsible adult.
  • Academic Background: We offer tuition for all academic levels, from primary to higher secondary. Students must provide accurate information about their current academic level during registration to be matched with appropriate tutors.
  • Commitment to Learning: Students should demonstrate a genuine interest in learning and be willing to commit to the tutoring sessions. Disruptive behavior or a lack of interest may result in discontinuation of services.

1.2. For Tutors:

  • Qualifications: Tutors must have the necessary educational qualifications to teach the subjects they are applying for. This typically includes at least a bachelor’s degree in the relevant subject, although we may consider other qualifications based on experience and expertise.
  • Experience: Prior teaching or tutoring experience is highly preferred. Tutors must be able to demonstrate their ability to effectively teach and manage students of various ages and learning capabilities.
  • Background Check: All tutors are required to undergo a background check to ensure the safety and security of our students. This includes verification of educational qualifications, address proof and professional references.
  • Professionalism: Tutors must exhibit professionalism in their conduct, including punctuality, respect for students, and adherence to the Centre’s guidelines and code of conduct.

Accounts

At SB Tuition Centre, we offer a streamlined and secure account management system for both students and tutors. Creating an account allows users to access our full range of services, manage their schedules, track their progress, and communicate with each other.

1.3. Account Creation:

   For Students and Parents:

  • Registration: Students or their parents/guardians must register for an account on our website. This process involves providing accurate personal information, including the student’s name, age, academic level, and contact details.
  • Account Verification: After registration, users will receive a verification email or SMS. The account must be verified to ensure security and to activate the full range of services.
  • Profile Setup: Once verified, students/parents can complete the profile by adding details about their learning needs, preferences for tutors, and availability for sessions.

  For Tutors:

  • Registration: Tutors must create an account by providing their full name, contact details, educational background, and teaching experience.
  • Document Submission: Tutors are required to upload copies of their educational certificates and any other relevant documents during the registration process.
  • Account Approval: Once the registration and document submission are complete, the Centre will review the application. Approved tutors will receive an account activation notice, allowing them to start offering their services.

1.4. Account Management:

  • Privacy and Security: We prioritize the privacy and security of our users. All personal information is stored securely, and our website is equipped with advanced security measures to protect against unauthorized access. Users are encouraged to create strong passwords and to regularly update them.
  • Account Termination: Users can terminate their accounts at any time by contacting our support team. However, any outstanding payments or sessions must be settled before the account can be closed. In cases of misconduct or breach of terms, the Centre reserves the right to terminate accounts without prior notice.

1.5. Fees and Payments:

  • For Students: The first month’s tuition fee is to be paid directly to SB Tuition Centre upon the commencement of tuition. Subsequent payments are made directly to the tutor after each session. An administrative fee (Rs 500 only) is required to pay upon successfully matching a student with a tutor.
  • For Tutors: Tutors will receive their first month’s payment from SB Tuition Centre after deducting the administrative fee and service charge of first month. Subsequent tuition fees are payable directly to the tutor on a convenient payment schedule by the parents. The home tutor is required to pay 15% of tuition fees for each month as service charges and Rs 500 (a one- time non-refundable Administration fee) to the Centre.

1.6. Support:

  • Technical Assistance: Should you encounter any issues with your account or need assistance with the registration process, our support team is available to help. We offer support through email, phone, and live chat on our website.
  • Feedback and Improvement: We encourage both students and tutors to provide feedback on their experiences. This helps us improve our services and ensure that all users have a positive experience at SB Tuition Centre.

6.Term and Termination

Term of Service

SB Tuition Centre offers flexible, ongoing services designed to meet the educational needs of students and the professional goals of tutors. The following outlines the terms under which these services are provided:

6.1. Duration of Engagement:

  For Students:

  • Students may enroll in tutoring services on a session-by-session basis or for a fixed term (e.g., monthly, quarterly). The term begins once the student has completed registration and made the initial payment to SB Tuition Centre.
  • Ongoing Engagement: There is no mandatory long-term commitment for students unless they opt for a fixed-term package. However, students are encouraged to maintain regular attendance to maximize the benefits of the tutoring sessions.

 For Tutors:

  • Tutors are engaged on a continuous basis, allowing them to offer their services as long as they meet the Centre’s standards and maintain an active status. Tutors are required to commit to the sessions they have agreed to with students and adhere to the Centre’s code of conduct.

6.2. Renewal of Services:

Automatic Renewal: For students enrolled in fixed-term packages, services will automatically renew at the end of the term unless the student or their guardian opts out of renewal by notifying the Centre in writing at least seven days before the renewal date.

Session-by-Session: Students who pay on a session-by-session basis are not subject to automatic renewal. They may book additional sessions at their convenience, subject to tutor availability.

Termination of Service: Both students and tutors at SB Tuition Centre have the right to terminate their engagement under certain conditions. The following outlines the termination process and the implications for both parties:

6.3. Termination by Students:

Voluntary Termination: Students may choose to terminate their engagement with the Centre at any time. To do so, they must notify the Centre in writing via email or through their account dashboard.

Refunds: If the student has prepaid for a fixed-term package, they may be eligible for a partial refund, depending on the number of sessions attended. Refund requests must be made within 14 days of the termination notice. No refunds will be provided for missed sessions unless there is a valid reason such as medical emergencies.

Termination Due to Dissatisfaction: If a student is dissatisfied with the tutoring services, they may terminate their contract and request a change of tutor. The Centre will attempt to resolve the issue by offering an alternative tutor before processing the termination.

Automatic Termination: The Centre reserves the right to automatically terminate a student’s engagement if they repeatedly miss sessions without valid reasons or engage in behavior that disrupts the learning environment.

6.4. Termination by Tutors:

Voluntary Termination: Tutors may terminate their association with SB Tuition Centre by providing a minimum of 30 days’ notice in writing. This allows time for the Centre to arrange a replacement tutor for the affected students.

Termination for Non-Compliance: The Centre reserves the right to terminate a tutor’s engagement without notice if they fail to comply with the Centre’s policies, including but not limited to unprofessional behavior, frequent cancellations, or inadequate performance as reflect ed in student feedback.

Implications of Termination: Upon termination, tutors will receive payment for any completed sessions. However, they forfeit any right to further payments for upcoming sessions they had previously committed to.

6.5. Termination by SB Tuition Centre:

Breach of Terms: The Centre may terminate the engagement of either students or tutors if there is a breach of the terms outlined in this agreement or other policies of the Centre. This includes, but is not limited to, dishonest behavior, non-payment of fees, or violation of the Centre’s code of conduct.

Immediate Termination:  In cases of severe misconduct, illegal activities, or actions that threaten the safety and well-being of others, the Centre reserves the right to immediately terminate the account of the student or tutor without prior notice.

Suspension: Before termination, the Centre may choose to suspend the account of a student or tutor pending investigation of any alleged misconduct. During this period, all services will be on hold until a final decision is made.

6.6. Post-Termination Obligations:

Outstanding Payments: Both students and tutors are required to settle any outstanding payments before their accounts are closed. Failure to do so may result in legal action or referral to a collections agency.

Return of Materials: If any materials, books, or equipment were provided by the Centre, they must be returned in good condition within seven days of termination. Failure to return these items may result in additional charges.

Confidentiality: Even after termination, both students and tutors are expected to maintain the confidentiality of any proprietary information or personal data they had access to during their engagement with the Centre.

6.7. Re-engagement After Termination:

For Students: Students who wish to re-engage with SB Tuition Centre after termination must reapply and may be subject to new terms and conditions. Previous violations may affect eligibility for re-engagement.

For Tutors: Tutors who wish to return after termination must undergo a re-evaluation process, which may include re-submission of credentials and interviews. Depending on the reason for termination, re-engagement may not be permitted.

6.8. Final Provisions:

Governing Law: The terms and conditions regarding termination are governed by the laws of the state in which SB Tuition Centre operates. Any disputes arising from termination will be resolved under the jurisdiction of the local courts.

Modifications: SB Tuition Centre reserves the right to modify these terms at any time. Notice of changes will be provided to all users, and continued use of the Centre’s services after modification constitutes acceptance of the new terms.

8.5. Limitations of Indemnification

It is important to note that indemnification does not cover the following:

  • Gross Negligence or Willful Misconduct: Indemnification will not apply in cases where the indemnified party has engaged in gross negligence or willful misconduct.
  • Indirect or Consequential Damages: Indemnification does not cover indirect or consequential damages, such as loss of profits, loss of business opportunities, or reputational harm.
  • Non-Compliance: If the indemnified party fails to comply with the procedures for indemnification, including timely notification and cooperation, the indemnifying party may be released from its indemnification obligations.

8.6. Governing Law and Jurisdiction

The indemnification terms outlined herein are governed by the laws of the state in which SB Tuition Centre operates. Any disputes arising out of or in connection with these indemnification terms shall be subject to the exclusive jurisdiction of the local courts.

8.7. Final Provisions

SB Tuition Centre reserves the right to amend these indemnification terms at any time. Users will be notified of any changes, and continued use of the Centre’s services following such changes will constitute acceptance of the new terms.

By agreeing to these indemnification terms, students, parents, and tutors acknowledge their understanding of their responsibilities and the protections afforded to SB Tuition Centre. These terms are designed to foster a fair and secure environment where all parties can focus on education and personal growth.

 9. Dispute Resolution and Arbitration

At SB Tuition Centre, we are committed to fostering a positive and productive environment for all our users, including students, parents, and tutors. However, we recognize that disputes may occasionally arise. To address these situations efficiently and fairly, we have established the following dispute resolution and arbitration procedures under terms of use.

9.1. Informal Dispute Resolution

Before resorting to formal arbitration, SB Tuition Centre encourages all parties to attempt to resolve any disputes through informal means. This process is designed to be collaborative and aims to reach a mutually acceptable solution:

  • Initial Communication: If a dispute arises, the concerned party (whether a student, parent, or tutor) should first communicate the issue directly to the other party involved. Open and honest communication often resolves misunderstandings quickly.
  • Reporting to SB Tuition Centre: If the dispute cannot be resolved through direct communication, the issue should be reported to SB Tuition Centre’s support team. This can be done via email, phone, or through the contact form on our website. The report should include a detailed description of the issue, relevant dates, and any supporting documentation.
  • Mediation: Upon receiving the report, SB Tuition Centre will assign a mediator from its staff to facilitate discussions between the parties. The mediator will attempt to help both sides reach a resolution. This process is confidential, and the mediator’s role is to assist in finding a fair and amicable solution, not to impose a decision
  • Resolution Timeline: The informal dispute resolution process is typically completed within 30 days of the initial report. However, this timeline may be extended if both parties agree that additional time is necessary to reach a resolution.

9.2. Formal Dispute Resolution: Arbitration

If the informal dispute resolution process does not result in a satisfactory outcome, the parties agree to resolve the dispute through binding arbitration, rather than through court litigation. Arbitration is a more formal process than mediation but is generally quicker, less expensive, and less adversarial than going to court.

  • Agreement to Arbitrate: By using the services provided by SB Tuition Centre, all users (students, parents, and tutors) agree that any disputes or claims arising out of or in connection with their use of the Centre’s services will be resolved exclusively through binding arbitration.

Arbitration Process:

  • Initiating Arbitration: The party seeking arbitration must send a written demand for arbitration to the other party and to SB Tuition Centre. This demand should outline the nature of the dispute, the relief sought, and any relevant documentation.
  • Selection of Arbitrator: The arbitration will be conducted by a single arbitrator who is mutually agreed upon by both parties. If the parties cannot agree on an arbitrator within 14 days of the demand, the arbitrator will be appointed by a reputable arbitration service chosen by SB Tuition Centre.
  • Arbitration Venue and Rules: The arbitration will take place in Nagaon district, Assam, unless both parties agree to a different location.
